DICTIONARY 

Hirers are responsible for any loss or Damage to the RV occurring On Hire, subject to these terms and conditions. It is important that Hirers confirm the condition of the RV at start of the Hire by completing the Pre-Hire Checklist with the RV Owner via the Camplify App and following the steps set out in the Handover Process in the Hirer Rules

This document sets out the inclusions and exclusions of the Accident Excess Reduction. Capitalised Terms are defined in the Dictionary at the end of this document.  

Accident Excess Reduction does not apply to any accident, damage or liability arising if a hire is outside of the Camplify Platform, this includes cash hires and any additional days not recorded in a Booking. 

The Accident Excess Reduction applies to accidental property damage to the RV or Third-Party Property it does not provide:

  1. public liability cover for death or personal injury to any person. In some circumstances compulsory third party insurance (CTP Green slip) may apply;
  2. cover for loss of, or damage to, your personal belongings and equipment of any kind.

Camplify strongly recommends that all Hirers take out travel insurance that provides cover for their belongings and public liability.

ABOUT ACCIDENT EXCESS REDUCTION  

When you Hire an RV through Camplify we require that you take out accident excess reduction (AER) to cover your use of the RV while On Hire. The basic AER option is “Risk Taker”, you can further reduce your Accident Excess Amount by taking out “Happy Camper” AER.

Accident Excess Reduction applies to accidental property damage, as follows:

  1. Loss or Damage to the hired RV arising from an Accident, theft, storm, hail, flood and fire while On-Hire.  
  2. Damage to Third Party Property caused by your use of the RV while On Hire.

The AER offered by Camplify is not an insurance policy. The AER does not provide protection where you do not meet the eligibility criteria or where an exclusion applies. 

 

Subject to eligibility and the exclusions below, your excess is reduced to the Accident Excess Amount. The Accident Excess Amount is payable in respect of each Incident occurring whilst On Hire.  

The AER does not reduce any Young Driver Excess. The young driver excess applies to by Hirers and Authorised drivers under 25 in the event of an Accident-causing Damage and is payable in addition to the Accident Excess Amount. 

Eligibility 

 To be eligible for AER you must be:

  • the Hirer or Authorised Driver;
  • have a current unrestricted driver’s licence in the correct class to operate the RV;
  • meet the Owner’s hirer age restrictions, set out in the Listing. Generally, these are between 25 and 84 years of age, however some Owners permit hirers from 21 years of age. 

Only the Hirer or an Authorised Driver may operate the RV. Authorised Drivers must be recorded in the Pre-Hire Checklist. In no circumstances is a person under 21 years of age or with a provisional (P1 or P2) or learner driver’s licence permitted to hire or drive an RV.    

If you do not meet the eligibility criteria or allow anyone who is not an Authorised Driver to tow or drive the RV your AER will not apply, and you will be fully responsible for any liability, loss or Damage.

Off Road Cover 

Hirers with an approved Off Road RV Booking must take out an Off Road AER package. The Off Road AER package applies to travel on any gazetted unsealed road and access roads to recognised camping grounds less than 10 kilometres in length that are in good condition for 4WD access. Cover for use on access roads more than 10 kilometres requires prior approval from Camplify.

Off Road cover does not apply to Damage to suspension or drive-train components or underbody panels or apparatus fixed beneath the RV. 

EXCLUSIONS UNDER ACCIDENT EXCESS REDUCTION 

The AER will not apply and you will be fully responsible for any liability, loss or Damage where you or the Authorised Driver:

  1. were engaging in a Prohibited Use of the RV or not complying with the Owners rules set out in the Listing at the time of the Incident; 
  2. deliberately or maliciously caused loss or Damage to the RV, or allowed another person to do so with your express or implied consent;  
  3. used the RV in a dangerous or reckless manner, this includes:
    1. damage arising from lawful seizure or impounding of the RV where the seizure or impounding results from your or the Authorised Driver’s action or inaction;
    2. Underbody Damage cause by taking the RV Off Road in breach of the Hirer Rules, 
    3. reckless use of an approved Off Road RV whilst Off Road;
    4. Overhead Damage caused by driving a high clearance RV into an obstacle marked as having a lower clearance or other reckless act;
    5. failing to take reasonable precautions to safeguard the RV such as leaving the RV unlocked, windows open or keys in the RV;
    6. placing fuel in the water tank or water in the fuel tank, incorrect fuel usage, contaminated fuel in the RV including damage to the RV’s engine or fuel system; 
    7. failing the secure an awning, annex, close windows or secure hatches and contents of the RV before driving or towing;
    8. allowing water to escape from a shower base or shower recess. 

The Risk Taker AER does not apply to damage to tyres, windscreens, awnings and annexes. 

INCIDENTS LODGED UNDER ACCIDENT EXCESS REDUCTION

Reporting 

All loss or Damage to the RV or caused by your use of the RV must be reported to Camplify within 24 hours and, where applicable, the police in accordance with the Hirer Rules (see Accidents and Theft section)

You must complete Camplify’s Incident Report Form in respect of any loss or Damage and provide any other information we reasonably request. If you refuse to do so the AER will not apply, and you will be fully responsible for the loss or Damage.

You must not make any misrepresentation of any facts or commit fraud or any other dishonest or deceptive act in connection with the Damage report or our investigation of the Damage. If you do so, the AER will not apply and you will be fully responsible for the loss or Damage.  

The Owner may also report Damage occurring On Hire to Camplify via the Post-Hire checklist. It is important that you review the Post Hire Checklist. If you disagree with any Damage recorded in the Post Hire Checklist you should raise this with the Owner at first instance. You must also complete an Incident Report Form at Camplify’s request. If you and the Owner do not agree on the cause of the Damage, the dispute should be referred to Camplify. See Disputes Resolution Policy)

Assessment 

If loss or Damage occurs On Hire you will be responsible unless you can show to our reasonable satisfaction that the loss or Damage was caused by the Owner, an equipment fault or a third party whose details you have provided to Camplify. 

Subject to any applicable young driver excess, where the AER applies your liability will be limited to your Accident Excess Amount (which is chargeable per Incident). You authorise Camplify to charge the Accident Excess Amount, and any applicable Young Driver Excess, to your Payment Method. 

If you’re not eligible under the AER or an exclusion applies you will be fully responsible for the loss or Damage. In respect of:

  1. loss or Damage to the RV: - you authorise Camplify to charge the full cost of rectifying Damage to the RV, which in the case of a total loss will be the market value of the RV, to your Payment Method. Where the Payment Method is insufficient or the charge is declined, the cost will become a debt due and payable to Camplify and Camplify, or our insurers, may take any action legally available to pursue that debt at your cost including referral to Camplify’s debt collection agency.
  2. Damage to Third Party Property: - you authorise Camplify to advise any person who makes a claim against Camplify regarding such Damage that the RV was in your custody at the time of the Incident and to provide your name and contact details.  

 


DICTIONARY 

Accident means unforeseen event, mishap or incident that results in Damage to the RV, the RV’s contents or Third Party Property.  

Accident Excess Amount means the excess amount shown in the Booking.

Authorised Driver means any driver, other than the Hirer, recorded in the Pre-Hire Checklist as being authorised to drive the RV whilst On Hire.

Booking means a booking of an RV made using the Camplify Platform for the dates recorded in the Camplify Platform.

Damage means:

  1. any loss or damage to the RV including its parts, components and accessories, however caused, that requires repair or replacement, subject to Fair Wear and Tear;
  2. any loss or damage to Third Party Property including motor vehicles 
  3. towing and salvage fees;
  4. assessing fees; and

excludes pre-existing damage.   

Fair Wear and Tear means as is set out in the Fair Wear and Tear Guide which may be amended from time to time.

Hirer means the hirer who has made the applicable Booking. 

Hire Rules means the rules applicable to Hirers as amended from time to time.

Incident means a single occurrence, or a series of occurrences arising out of the one event causing loss or Damage. 

Listing means a listing describing an RV prepared by an Owner published on the Camplify Platform. 

Off Road means any unsealed road except:

  1. well maintained access roads less than 10 kilometres in length that are used for access to recognised camping grounds; or 
  2. a road where roadwork is being conducted by a statutory road authority.

On Hire means the period, recorded on the Camplify Platform, during which an RV is in the custody or control of a Hirer. 

Overhead Damage means overhead damage to the RV whilst On Hire, and more specifically:

  1. for motorhomes and campervans, overhead damage means Damage above the top of the door seal or the top of the front and back windscreens; 
  2. for caravans and pop ups, overhead damage means Damage to anything or anywhere above the area where the side walls meet the roof of the van; and
  3. damage to Third Party Property, caused by the RV coming into contact with anything overhanging or obstructing its path, objects being placed on the roof of the RV, or Hirer or any person standing or sitting on the roof of the RV.

Owner means the registered owner of an RV.

Payment Method means the payment method associated with the Hirer’s Camplify account such as credit card or debit card.

Post-Hire Checklist means the post-hire checklist found on the Camplify App to be completed at the end of each Hire.

Pre-Hire Checklist means the pre-hire checklist found on the Camplify App, to be completed on the commencement each the Hire.

Prohibited Use means any use of the RV which is prohibited by the Hirer Rules

RV means any motorhome, campervan, caravan, camper trailer, tow vehicle or other category of recreational vehicle approved by Camplify and offered by an Owner for Hire on the Camplify Platform.

Third Party Property means any property belonging to a person other than the Owner, the Hirer or persons travelling with the Hirer during the Booking. 

Underbody Damage means damage to the RV caused by an impact to the underside of the RV by an impact with the road or any obstruction that does not arise as a result of an impact with another vehicle.

Young Driver Excess means the additional excess set out on the Camplify Platform payable by Hirers and Authorised drivers under 25 in the event of an Accident causing Damage.
