Damage On Hire
Definitions
This Bring Your Own (BYO) Membership Agreement applies to Owners who choose the BYO Membership option when signing up to the Camplify Platform.
This agreement applies in addition to, and does not replace, the Camplify Terms of Service. It is a condition of your membership that you comply with the Terms of Service, Owner Rules and Community Rules. Any suspension or termination of your account under the Terms of Service will automatically suspend or terminate (as applicable) your membership under this agreement.
This BYO Membership Agreement shall be construed in accordance with and shall be governed by the laws in force in the State of New South Wales.
Camplify BYO Membership - BYO membership benefits
- Your BYO Membership allows hire of your RV to Hirers aged 21 years to 84 years, who are fully licenced provided that this is within the limits of your BYO insurance policy. Your listing must reflect any restrictions for ages that may apply to your current BYO insurance policy.
- National roadside assistance whilst On Hire (subject to the towing distance and annual benefit caps set out in the Terms of Service).
- As a BYO Member you have the choice and flexibility to hire your RV out on multiple platforms.
Camplify BYO membership - Commission
As a BYO Member you will be charged a 12.5% commission on each booking. The commission is charged on the hire fees (including fees for hire of ancillary items, and services such as delivery) paid in respect of the booking. Camplify may vary the commission on 30 days’ notice in accordance with our Terms of Service.
Camplify BYO Membership - Comprehensive Damage Cover requirements
To meet the requirements of the Terms of Service that “All RVs must have comprehensive damage cover, covering both damage to the RV and loss or damage to third party property” BYO Members must have a personal comprehensive insurance product covering use of your RV whilst On Hire. You must provide a certificate of currency for this insurance to Camplify when signing up to the Camplify Platform and when your insurance is renewed showing:
- The registration number, year, make & model, VIN Chassis of your RV;
- Value of cover (i.e. market or agreed)
- cover for On Hire use;
- the applicable excess.
You warrant to Camplify that the coverage of your Bring Your Own Insurance:
- is appropriate and sufficient to cover the RV for accident or damage, On Hire;
- provides the Hirer and any Authorised Driver with an appropriate and sufficient level of cover in the event of third-party property damage being caused by the use their use of the RV On-Hire
Camplify recommends that the BYO insurance covers theft on hire. You acknowledge that the exclusions under your BYO policy are at your risk.
As a BYO Member your policy excess or the Risk Taker Accident Excess Amount applicable to the hire type, whichever is lower, is the maximum that can be claimed from the Hirer through Camplify per incident of damage occurring On Hire.
Damage On Hire
If damage occurs On Hire Camplify will manage all the matters with the Hirer regarding the Incident.
To be able to show that damage occurred On Hire BYO members must ensure that:
- all booking dates are correctly recorded in the Camplify Platform, including any adjustments to dates; and
- pre and post hire checklists are completed in accordance with the Owner Rules.
Camplify will review these to determine if the damage occurred On Hire. Except in the case of theft or a major incident (where your RV has needed to be towed from the scene of an accident), if the damage is not recorded on the post hire checklist and notified to Camplify within 48 hours of the end of the hire, it will be very difficult to establish that damage occurred during the hire. No additional damage can be claimed through Camplify after the post hire checklist has been completed and lodged to Camplify.
If Camplify accepts that damage occurred On Hire you will need to provide evidence to Camplify’s reasonable satisfaction of the costs to rectify the damage and/or your payment of the policy excess to your insurer. This can include:
- evidence that you have lodged a claim with your insurer and paid the policy excess; or
- if you have not lodged a claim with your insurer, quotes for the cost of repairing the damage. Camplify may request a further quote or have the damage accessed by a third-party assessor to confirm that the repair costs claimed are reasonable.
Camplify will require that the Hirer, or Authorised Driver where applicable:
- completes an Incident Report Form;
- provides details of the police report (in the case of theft or an accident required to be reported to police) and
- if the damage was caused by a third party, name and address of the property at fault and registration of the other vehicle involved in the incident.
Except where the damage was caused by a person who isn’t the Hirer or Authorised Driver, Camplify will pay the reasonable repair costs up to the applicable excess and manage the claim on the Hirer. Where a third party is at fault Camplify will pass the third party’s details obtained from the Hirer on to you so that you can provide these to your insurer. Camplify will provide a copy of the Incident Report Form completed by the Hirer if required by your insurer to confirm third party fault.
Definitions
For the purposes of this agreement:
Authorised Driver means any driver, other than the Hirer, recorded in the Booking and/or the pre-hire checklist as being authorised to drive the RV whilst On Hire.
Hirer means the hirer who has made the applicable booking.
Incident means a single occurrence, or a series of occurrences arising out of the one event causing loss or damage.
On Hire means the period, recorded on the Camplify Platform, during which an RV is in the custody or control of a Hirer under a booking made on the Camplify Platform.
Risk Taker Accident Excess Amount means the risk taker accident excess displayed on the Camplify Platform applicable to the hire type.
